AETHERLINK COMMUNITY GUIDELINES

1. INTRODUCTION

Welcome to the AetherLink community. These Community Guidelines ('Guidelines') establish the standards of conduct expected from all users ('Users', 'you') when accessing or utilizing the AetherLink website (the 'Site'), the AetherLink mobile application (the 'App'), and any related products and services (collectively, the 'Services') operated by Playcia ('Company', 'we', 'us', 'our').

These Guidelines are designed to foster a safe, respectful, inclusive, and authentic environment for all Users. They supplement, and are hereby incorporated by reference into, our comprehensive Legal Terms (also referred to as Terms of Service or TOS) and our Privacy Policy. Your access to and use of the Services constitutes your agreement to be bound by these Guidelines, in addition to the Legal Terms and Privacy Policy.

Failure to adhere to these Guidelines constitutes a breach of our Legal Terms and may result in enforcement actions, including but not limited to content removal, feature limitations, account suspension, or permanent account termination, as outlined in Section 12 ('TERM AND TERMINATION') of our Legal Terms.

2. CORE PRINCIPLES

Our community is built upon the following fundamental principles:

  • Respect and Civility: Engage with fellow Users courteously and respectfully. Constructive dialogue and disagreement are permitted, but personal attacks, insults, derogatory language, and malicious behavior are strictly prohibited.
  • Safety and Well-being: Prioritize the safety and well-being of all Users. Do not engage in conduct or share content that threatens, endangers, harasses, or harms others, whether physically, emotionally, or financially.
  • Authenticity and Legality: Represent yourself truthfully and utilize the Services in full compliance with all applicable local, national, and international laws and regulations, as well as our Legal Terms. Respect intellectual property rights and the privacy of others as detailed herein and in our Privacy Policy.

3. PROHIBITED CONDUCT AND CONTENT

To maintain the integrity, safety, and intended purpose of the Services, Users are strictly prohibited from engaging in the activities or posting the types of content listed below. This list is illustrative and not exhaustive; we reserve the right to address conduct or content not explicitly listed if it violates the spirit of these Guidelines or our Legal Terms (specifically Section 5, 'PROHIBITED ACTIVITIES').

  • Illegal Activities: Using the Services to conduct, promote, or facilitate any illegal activity. This includes, but is not limited to, copyright or trademark infringement, selling or promoting illegal substances or services, fraud, scams, or violating any applicable laws or regulations mentioned in Section 1 ('OUR SERVICES') and Section 14 ('GOVERNING LAW') of the Legal Terms.
  • Harassment, Bullying, and Abuse: Engaging in targeted harassment, intimidation, bullying, or abuse directed at other Users or individuals. This encompasses persistent unwanted contact, derogatory insults, threats, malicious reporting, attempts to silence others, or using information obtained from the Services to harass, abuse, or harm another person.
  • Hate Speech and Discrimination: Posting content or engaging in conduct that attacks, demeans, promotes violence against, or incites hatred or discrimination towards individuals or groups based on protected characteristics such as race, ethnicity, national origin, religion, caste, sexual orientation, gender, gender identity, age, serious disease or disability, veteran status, or immigration status.
  • Threats, Violence, and Dangerous Content: Making credible threats of physical violence against individuals or groups; inciting or glorifying violence; promoting dangerous activities, self-harm, suicide, or eating disorders. Content depicting gratuitous violence or gore is also prohibited. This aligns with our right to process information to protect vital interests (Section 2 of Privacy Policy).
  • Impersonation and Misrepresentation: Impersonating other individuals, groups, or organizations in a deceptive or misleading manner. Creating accounts under false pretences, providing false registration information (violating Section 3, 'USER REPRESENTATIONS' of Legal Terms), or misrepresenting your affiliation with any person or entity.
  • Spam, Scams, and Automated Misuse: Distributing unsolicited commercial messages (spam), engaging in phishing or fraudulent schemes, or manipulating the platform through automated means (bots, scripts) for purposes such as creating accounts, sending messages, or artificially inflating engagement. This includes systematic data retrieval ('scraping') as prohibited in Section 5 of the Legal Terms.
  • Intellectual Property Infringement: Posting or distributing content that infringes upon the copyrights, trademarks, patents, trade secrets, or other intellectual property rights of others. Users must have the necessary rights or licences for all content shared. Refer to Section 2 ('INTELLECTUAL PROPERTY RIGHTS') and Section 11 ('DIGITAL MILLENNIUM COPYRIGHT ACT (DMCA) NOTICE AND POLICY') of our Legal Terms.
  • Privacy Violations: Sharing or soliciting private, personal, or confidential information of others without their explicit, verifiable consent. This includes, but is not limited to, non-public phone numbers, physical addresses, email addresses, login credentials, financial information, government identification numbers, medical information, or intimate media shared without consent ('non-consensual pornography'). User data handling is governed by our Privacy Policy.
  • Minor Safety: Posting, sharing, or soliciting content that exploits, abuses, endangers, or sexualizes minors. This includes Child Sexual Abuse Material (CSAM) and grooming behaviors. Users must adhere to the age restrictions outlined in Section 1 ('AGREEMENT TO OUR LEGAL TERMS') of the Legal Terms.
  • Platform Manipulation and Security: Attempting to circumvent security measures, interfere with the proper functioning of the Services, introduce malware (viruses, Trojan horses), probe vulnerabilities, reverse engineer platform code (except as permitted by law), or create an undue burden on our systems or networks, as detailed in Section 5 ('PROHIBITED ACTIVITIES') and Section 9 ('SERVICES MANAGEMENT') of the Legal Terms.
  • Unauthorized Commercial Activity: Using the Services for unauthorized commercial purposes, including selling accounts, promoting pyramid schemes, or conducting commercial solicitations not explicitly permitted by us.

When you create, submit, post, display, transmit, or otherwise make available content and materials ('Contributions') on the Services:

Maintaining the security of your account is crucial:

  • Registration Accuracy: You must provide true, accurate, current, and complete information during registration and maintain its accuracy, as required by Section 3 ('USER REPRESENTATIONS') and Section 4 ('USER REGISTRATION') of the Legal Terms.
  • Password Confidentiality: Keep your password confidential and do not share it. You are responsible for all activities conducted through your account (Section 4, Legal Terms).
  • Unauthorized Use: Notify us immediately if you suspect any unauthorized use of your account.

6. PRIVACY CONSIDERATIONS

  • Privacy Policy: All personal information collected and processed through the Services is governed by our Privacy Policy. By using the Services, you consent to the data practices described therein, including collection, use, storage, and potential sharing of your information (Sections 1, 2, 4, Privacy Policy).
  • Respect Others' Privacy: Do not share personal or private information about other individuals without their explicit consent. Be mindful of the information you share publicly.
  • Data Rights: Understand your rights regarding your personal information (access, correction, deletion, etc.) as detailed in Section 8 ('WHAT ARE YOUR PRIVACY RIGHTS?') and region-specific sections (Sections 10, 11) of the Privacy Policy. You can exercise these rights as described in Section 14 of the Privacy Policy.

7. TERMS OF SERVICE (TOS) SUMMARY & KEY PROVISIONS

These Community Guidelines are a part of, and must be read in conjunction with, our full Legal Terms (TOS) available at /terms. The Legal Terms constitute a legally binding agreement between you and Playcia. Key provisions relevant to community conduct include:

  • Agreement: By accessing or using the Services, you explicitly agree to be bound by the full Legal Terms (Section 1, Legal Terms). If you do not agree, you must cease using the Services immediately.
  • Eligibility: You must meet the age requirements (generally 13+, with parental consent for minors) specified in Section 1 of the Legal Terms.
  • User Representations: You warrant that your registration information is accurate and that your use of the Services complies with all applicable laws and the Legal Terms (Section 3, Legal Terms).
  • Prohibited Activities: The Legal Terms detail a comprehensive list of prohibited activities (Section 5, Legal Terms), many of which are summarized in Section 3 of these Guidelines. Violating these prohibitions can lead to account termination.
  • Intellectual Property: All content and marks on the Services are owned by or licensed to us. Your use is limited by the licence granted in Section 2 of the Legal Terms. You grant us a licence to use your Contributions as detailed in Section 7 of the Legal Terms.
  • Disclaimers and Liability: The Services are provided 'AS IS'. Our liability is limited as described in Section 17 ('DISCLAIMER') and Section 18 ('LIMITATIONS OF LIABILITY') of the Legal Terms.
  • Termination: We reserve the right to suspend or terminate your account and access to the Services for any reason, including violation of the Legal Terms or these Guidelines (Section 12, Legal Terms).
  • Governing Law and Disputes: The Legal Terms specify the governing law (Romania) and dispute resolution procedures (informal negotiation, binding arbitration) (Sections 14 & 15, Legal Terms).

8. RELATIONSHIP TO LEGAL TERMS AND PRIVACY POLICY

  • Integral Part: These Community Guidelines, the Legal Terms (TOS), and the Privacy Policy together govern your use of the Services.
  • Binding Agreement: These documents collectively form a legally binding agreement.
  • Precedence: In case of any conflict between these Guidelines and the Legal Terms or Privacy Policy, the provisions of the Legal Terms and Privacy Policy shall take precedence.

9. ENFORCEMENT

We reserve the right, but not the obligation, to monitor the Services for violations of these Guidelines and our Legal Terms (Section 9, 'SERVICES MANAGEMENT'). Enforcement actions are taken at our sole discretion and may include:

  • Content removal or modification.
  • Issuing warnings.
  • Restricting account features.
  • Temporary account suspension.
  • Permanent account termination (Section 12, Legal Terms).
  • Reporting illegal activity to law enforcement authorities.

We aim for fairness and consistency in enforcement but reserve the right to act as necessary to protect the community and the Services.

Provide specific details (e.g., username, link to content, description of violation) to aid our investigation.

We may update these Community Guidelines periodically to reflect evolving community standards, platform features, or legal requirements. We encourage you to review these Guidelines regularly. Material changes will be communicated through the Services or by other appropriate means.
